Draft Charging Schedule – submitted for independent examination

The Community Infrastructure Levy (CIL) (as set out in the Planning Act 2008) is a new system of developer contributions and is intended to supplement other public sector funding streams to ensure that new community infrastructure (such as schools and health care facilities) can be provided to keep pace with population growth. CIL is set locally and will become a standard charge per square metre applied to all developments, with the exception of social housing, buildings used by charities and buildings into which people do not normally go, or go only for routine maintenance of plant or equipment. The charge will be imposed at the time planning permission is granted and normally be paid at the commencement of development.

CIL will replace Section 106 contributions for general types of community infrastructure, however Section 106 will still be used for site specific mitigation measures that are required to make a development acceptable (such as a new access road) as well as for affordable housing provision.

CIL is to be paid according to a Charging Schedule prepared by the Charging Authority. In February and March 2011 London Borough of Redbridge consulted on a Preliminary Draft Charging Schedule. Following consideration of all the representations it received, the Council published a Draft Charging Schedule for further consultation between 10 May and 10 June 2011. In light of the formal representations received during the draft consultation, the draft charging schedule was formally submitted  on 22nd June 2011 to the Planning Inspectorate for independent examination, in accordance with section 212 of the Planning Act 2008.

Geoff Salter BA MRTPI was appointed by London Borough of Redbridge as the independent Examiner to conduct the examination.

He formally submitted his final report on 9 September 2011 and recommended that the Redbridge Charging Schedule be approved in its published form. The Council anticipate that the CIL Charging Schedule be considered by full Council for implementation at its meeting in November 2011.

The Charging Schedule must be informed by appropriate evidence which should include:

An “up to date” development plan, ie the Local Development Framework (LDF). Redbridge has one of the most advanced and complete LDFs in the country and so is in a strong position to bring forward CIL.

  • Infrastructure planning consistent with Government guidance in the form of Planning Policy Statement 12 – Redbridge published a Community Infrastructure Plan (CIP) in December 2009 to set out the amount and cost of infrastructure required to support growth in the LDF (ie a minimum of 9,050 additional homes between 2007 and 2017). The CIP also set out three potential options for a Community Infrastructure Levy. The CIP is an evolving document and is regularly updated in light of continuous dialogue with service providers – the latest January 2011 update is also set out below.

  • A broad assessment of the potential impact of CIL on the viability of development – this has been carried out independently by BNP Paribas Real Estate. Government guidance says that the levy should not be set so high as to stifle development, nor should it be set so low that insufficient funds are available for infrastructure.

  • In addition to the above, Redbridge has also published an Addendum document which explains the impact of recent changes in Government policy and legislation as it relates to CIL and the Mayor of London’s own proposals for a CIL to help fund Crossrail. The Addendum also summarises each of the representations received on the Preliminary Draft Charging Schedule and the Draft Charging Schedule, stating how the Council responded to them. In this way the Addendum forms part of the evidence base and the Regulation 19(b) statement relating to formal representation.

In light of this preparatory work it is proposed that the Redbridge CIL will be set at a flat rate of £70/m² for all types of development across the borough.
