Adopted and private roads, alleyways, public rights of way

This is a complete list of all known roads in the Borough
and whether the road is adopted, council maintained, private or has
a Section 38 Agreement.

Adopted Roads
An adopted road is a road and pavement where the Council is
responsible for maintenance.
However, there are roads that form part of Transport for
London Road Network (TLRN) formally known as Trunk Roads.
- A12 (Eastern Avenue)
- A1400 (Woodford Avenue/Southend Road)
- A406 (Barking Relief Road)
- M11 Motorway
The highway authority responsible for these roads
is Transport for London (TfL). Therefore, if you have any queries
regarding these roads you need to contact TfL direct.
Council maintained
These roads and footpaths generally form part of
a Council Housing Estate and are therefore the responsibility of
the Housing department. If you have any queries regarding a Council
maintained road you would need to contact Housing Services.
Non adopted roads (Private roads)
Non adopted roads are private. This means that the Council
is not responsible for the maintenance of these roads including
streetlights, pavements, drop kerbs or anything else related to the
highway. Where the Council is not responsible for maintenance
you will need to contact the developer of the site.
On a new development where the road may still be private or
there may be a Section 38 Agreement you will need
to contact the developer of the site. Alternatively, you may need
to contact the Land
Registry to find out who owns the land.
Section 38
A section 38 is where private developers want the Council to
adopt the road. If a road has a Section 38 it is
still owned by the private developer and therefore is the
developer's responsibility to maintain. The Council
will not maintain this road until the Private developer has met
Council requirements. Only then will the Council adopt the
road.
Getting a copy of a Section 38
If you would like a copy of a Section 38 Agreement then you will
need to write to our legal Services Department:
- Legal Services, Corporate and Property Services Group, Town
Hall, High Road, Ilford, Essex, IG1 1DD.
In your letter, please state:
- the date of the Section 38 Agreement
- the original developer
- your address and most importantly your telephone number.
We will then call you to let you know how much it will
cost for the agreement. Cost depends on the size of the
document. At that point you can decide whether or not to
purchase it. We will organise payment with you should you wish
to go ahead.
Alleyways and Public Right of Way (ProW)
These are basically pathways. These can either be
formally adopted, maintained as part of a Council owned Housing
Estate or private. You will find alleyways and Public Rights
of Way:
- between buildings
- on Council owned estates
- in parks

Further Information
You will need to contact us if you want to
know whether any part of a road, pavement, pathway or grassed area
is private or adopted.
You will need to put your request in writing
enclosing a plan showing the exact location of your query. There is
a charge of £10.00 per area to cover inspection and administration
costs. We will reply to your enquiry within 10 working days
enclosing a coloured plan showing the extent of adoption.
