Apply for a review
The review helps the Council to look
at an existing premises licence and decide whether
its conditions are adequate to meet the four licensing objectives defined under the Licensing
Act 2003.Any interested party or responsible authority may make a representation in support of a
review.
Who is the service for?
You can apply for a review if you are a responsible authority or
if you are:
- a person living in the vicinity of the premises
- a body representing persons who live in that vicinity
- a person involved in a business in the vicinity of the
premises
- a body representing persons involved in these businesses.
On what grounds can you apply for a review?

All information, including in your diary of incidents, must
relate to one or more of the statutory licensing objectives.

The Licensing Authority will reject any request for a review
that is " frivolous, vexatious or repetitious
of matters already considered"
How to apply for a review?
- Any application for a review must be made
in writing on the prescribed application
form for a review (PDF 86.5KB), which you can download, or we
can send you a copy.
- You can ask a friend, solicitor or
elected member to submit a review application, or any
representation on your behalf, providing you say who you are.
- Once accepted, your application will be
made public and consulted upon for 28 days. The Council must send
it to the licence holder to give them an opportunity to respond
appropriately. We will remove unnecessary personal data, but
your name and address must be disclosed to all parties.
- A Licensing Sub-Committee hearing to
review the licence will take place in the month following the
consultation period. You will be invited to attend and address
the hearing, as will the licence holder.
What will you need to send to us?
- copies of all supporting documents, including a diary of
incidents, such as the noise record form below
- on the same day you must send a copy of the form which has your
name and address on it to the holder of the premises licence or
club premises certificate in question
- you also need to send a copy of your application form and
documents to each of the seven Responsible Authorities,
including the Police and Fire Authority.
The Council will advertise the fact that you
have asked for a review together with the reasons and inform other
responsible authorities such as the police and fire authority to
see if there are other parties interested in making
representations. Within 20 working days of the end of that period,
the licensing authority must hold a hearing where you put your case
forward.
What can I expect as an outcome of the review?
If your application for review is accepted it will be heard by
the Council’s Licensing Sub-Committee who may, following the
review:
- decide that no action is necessary to promote the licensing
objectives
- modify or add conditions to the licence
- remove the designated premises supervisor
- suspend the licence for a period (not exceeding 3 months)
revoke the licence.
