Questions to decide if you need a premises licence

These basic questions and answers have been designed to help youGlass of beer decide if you need a Premises Licence or need to issue a Temporary Events Notice.

However alcohol entertainment and late night refreshment licensing is a complicated subject.

 

Question 1

Will you be providing entertainment (plays, films, music, dance or sports) open to the general public or for consideration with a view to profit?

Answer  

Yes - Go to question 2.

No - Go to question 22.


Question 2

Will you be performing a play (including rehearsals)?

Answer  

Yes - Go to question 17.

No - Go to question 3.


Question 3

Will you be showing films or video?

Answer  

Yes - Go to question 4.

No - Go to question 6.


Question 4

Will the showing be solely to demonstrate a product, advertise goods, provide information, education or instruction?

Answer  

Yes - Go to question 6.

No - Go to question 5.


Question 5

Will it be part of a museum or art gallery exhibit?

Answer  

Yes - Go to question 6.

No - Go to question 16.


Question 6

Does the activity include boxing, wrestling, indoor sport?

Answer  

Yes - Go to question 16.

No - Go to question 7.

Does the activity include dance?

Answer  

Yes - Go to question 16.

No - Go to question 8.

Does the activity include live or recorded music?

Answer  

Yes - Go to question 9.

No - Go to question 22.

Is the music purely incidental to the main entertainment?

Answer  

Yes - Go to question 22.

No - Go to question 16.


Question 10

Will you be selling or supplying alcohol?

Answer  

Yes - Go to question 11.

No - You do not require a premises licence or temporary event notice

Is the alcohol solely for a raffle, tombola, etc. prize?

Answer  

Yes - Go to question 12.

No - Go to question 30.

Are any of the proceeds for private gain?

Answer

No - Go to question 13.

Will the alcohol be in sealed containers?

Answer  

Yes - Go to question 14.

Are there any monetary prizes?

Yes - Go to question 30.

Question 15

Will the tickets be sold and the prize be drawn only at event?

Answer  

Yes - You do not require a premises licence or temporary event notice

Question 16

Is the entertainment solely a simultaneous reception and broadcast by television or radio?

Answer  

Yes - Go to question 22.

No - Go to question 17.


Question 17

Is the entertainment part of a religious meeting?

Answer  

Yes - Go to question 22.

No - Go to question 18.


Question 18

Is the entertainment at a place of public worship?

Answer  

Yes - Go to question 22.

No - Go to question 19.


Question 19

Is the activity at fete (or similar) or not for private gain?

Answer  

Yes - Go to question 22

No - Go to question 20.

Will the activity be Morris Dancing or similar?

Answer  

Yes - Go to question 22.

No - Go to question 21.


Question 21

Will the activity take place on a vehicle that is moving (NOT parked)?

Answer  

Yes - Go to question 22.

No - Go to question 30.


Question 22

Will you be supplying hot food or drink from a premises or vehicle between 11.00 pm and 5.00 am?

Answer  

Yes - Go to question 24.

No - Go to question 23.


Question 23

Will you provide facilities for purchasers to heat supplied food or drink between 11.00 pm and 5.00 am?

Answer  

Yes - Go to question 24.

No - Go to question 10.


Question 24

Will the supply be to a recognised club member or guest, an employee, a guest at a hotel, guest house or similar overnight accommodation?

Answer  

Yes - Go to question 10.

No - Go to question 25.


Question 25

Will the late night supply be hot drink containing alcohol only?

Answer  

Yes - Go to question 10.

No - Go to question 26.


Question 26

Will the only supply be by a vending machine to a member of the public when they insert payment?

Answer  

Yes - Go to question 10.

No - Go to question 27.


Question 27

Will the hot food or drink be supplied free (it is not free if admission is charged to the premises or for other items)?

Answer  

Yes - Go to question 10.

No - Go to question 28.

Will the hot food or drink be supplied by a registered charity?

Answer  

Yes - Go to question 10.

No - Go to question 29.


Question 29

Will the hot food or drink be supplied solely on a moving vehicle (not parked)?

Answer  

Yes - Go to question 10.

No - Go to question 30.


Question 30

Will activity last less than 96 hours?

Answer  

Yes - Go to question 31.

No - You require a premises licence.

Do you hold a personal licence?

Answer  

Yes - Go to question 32.

No - Go to question 33.


Question 32

Have you or your immediate family, business partner etc given 50 temporary event Notice's in the current year?

Answer  

Yes - You require a premises licence.

No - Go to question 34.


Question 33

Have you or your immediate family, business partner etc given 5 temporary event Notice's in the current year?

Answer  

Yes - You require a premises licence.

No - Go to question 34.


Question 34

Have 12 temporary event Notice's already been served relating to the premises in the current year (by anybody)?

Answer  

Yes - You require a premises licence.

No - Go to question 35.


Question 35

Will the event and any others in the current year for which temporary event Notice's have been given exceed 15 days in total?

Answer  

Yes - You require a premises licence.

No - You must issue a temporary events notice or apply for a premises licence.
